Buying
an insurance policy is always an exercise in faith.
You purchase the insurance policy with the expectation that, should
an unexpected accident occur, you would be compensated for your
loss based on the policy guidelines. The four most common types
of insurance coverage include auto, homeowner, health and life insurance
plans.
Even though your insurance company sells you a policy, they are not necessarily working for you. Insurance is a business, and they lose money every time they must pay on a claim. As such, sometimes they attempt to avoid payment on legitimate claims. The three most common problems include:
- Denial of legitimate claims. In this situation, the insurance company assumes you have no way to challenge their decision. A claim is denied payment even though it is covered by your policy. By hiring an attorney, and showing a willingness to go to court to fight for what you deserve, you drastically reduce the chances of this happening. (See Insurance Bad Faith for more information.)
- Delay of legitimate claims. Insurance companies may take an unnecessarily long time to pay out a claim. This may be done because, from a financial standpoint, it benefits the insurance company in the eyes of shareholders to withhold payment for as long as possible. However, if you have an attorney willing to take the insurance company to court, it can greatly speed up the payment process. Insurance companies know that it's a greater financial risk to go to court than it is to simply pay out the claim in a timely manner.
- Purposefully poor wording of the policy language. Polices are long, complicated documents. It is easy to get lost in the jargon. In addition, for any insurance policy to cover every possible situation, it would prohibitive in size. That is why insurance policies are often worded very vaguely. However, in the event of any ambiguity in an insurance policy, the resolution must be to the benefit of you the policyholder. That is where having an experienced attorney on your side becomes very beneficial.
